Industrial Negligence and Product Liability Cases

  • Lead counsel for an oilfield equipment rental service named in a multi-million dollar case brought by the operator and driller of a natural gas well. The plaintiffs alleged that the client had provided two defective components of the rig’s blowout prevention system, which failed, causing the well to blowout. Mr. Kelly developed evidence that one of the components had actually been provided by a different company and that the client was an innocent retailer of the other component. All plaintiffs voluntarily dismissed the claims against Mr. Kelly’s client, for no payment, prior to trial.
  • Lead counsel for a directional drilling company in an action brought by an operator for alleged negligence, arising out of drilling operations in Oklahoma. After substantial discovery, the plaintiff conceded a traditional and no evidence motion for summary judgment. A final take nothing judgment was entered in favor of Mr. Kelly’s client.
  • Lead counsel for a directional drilling company in a negligence claim arising out of an alleged misuse of drilling equipment during operations, causing a loss of the hole. Mr. Kelly established that the failed equipment was operated by another party. The plaintiff agreed to dismiss its claims against Mr. Kelly’s client without payment of any settlement.
