Suits Against Government Entities
- Lead Counsel for real estate developer against a Houston Water Authority which rejected his client’s application for water and sewage utilities to a proposed apartment project. Mr. Kelly secured (1) a permanent injunction against the Water Authority requiring it to furnish the utilities to the client’s apartment project; (2) $7,500 in sanctions against the Water Authority for filing false discovery answers; and (3) a court order holding the Water Authority’s President in contempt.

- Lead counsel for the same apartment developer against the same Water Authority in a subsequent action for actual and punitive damages. The Water Authority reneged on a prior commitment to provide utilities to the developer’s 65 acre tract. The jury found the Water Authority breached its prior commitment with malice and denied the developer equal protection under the law. The jury awarded the client $7,350,000 in actual damages as well as punitive damages against three members of the Water Authority’s Board of Directors.
